Terms and conditions of purchase

These general conditions of sale (hereinafter, “General Conditions”) govern the purchase of products and services, carried out remotely via the internet, from the site olioterrerosse.com (hereinafter Site) in compliance with the law Italian pursuant to Legislative Decree 206/2005 and subsequent amendments and additions (hereinafter: “Consumer Code”).

The user of the site who intends to purchase (hereinafter “Customer”) is required, prior to the confirmation of sending the order, to carefully read these General Conditions which have been published on the Site and which will be available for consultation at any time by the Customer. also through the link contained in the confirmation email of each order to facilitate storage and reproduction. In the event that the user who purchases on the Site requests an invoice and / or is not a “consumer or user” as defined in art. 3, paragraph 1, lett. a), of the Consumer Code, the withdrawal regulations described in the specific section will not apply, because according to the same Consumer Code they apply only to “consumers”.

The agreements made with Azienda Agraria Hispellum through the Site are governed by these General Conditions in compliance with Italian law. The reference language for concluding the contract is Italian for sales whose shipments include Italy as the place of delivery and English for all other delivery locations.

The characteristics and the price of the various products for sale on the Site (hereinafter “Product” or “Products”) are shown on the page relating to each Product with a specific “Product Sheet”. The net weight, the Region and the Country of origin, the name of the Producer and a technical data sheet will be highlighted for each Product.

The Customer must add the Product / Products to the “Cart” and, after having read the General Conditions and the Privacy Policy Conditions and confirmed their acceptance with a flag in the appropriate field, must enter the shipping data, select the desired payment method and confirm the order. The invoice will be sent only upon request via an e-mail addressed to mciampetti@hispellum.com

By sending the order from the Site, which has the value of a contractual agreement, the Customer acknowledges and declares that he has read all the information provided during the purchase procedure, that he has read the technical data sheet and understood the characteristics of the Products and to fully accept these General Conditions and those of the selected payment.

The contract stipulated between “Azienda Agraria Hispellum” and the Customer must be considered concluded with the acceptance of the order by “Azienda Agraria Hispellum”. This acceptance is communicated to the Customer through an order confirmation email to the email address entered by the user during the order confirmation phase, this email will contain a reference to these General Conditions, the order number, the shipping data , the list of Products ordered and the total price, including VAT, where due, and the costs for making the delivery. The Customer will check the confirmation email and, if he identifies errors in the order, he will have 24 hours from receiving this email to contact “Azienda Agraria Hispellum” by phone at +39.340.8814.640 or by email by sending an e-mail to mciampetti@hispellum.com After this period of time, the order will be considered concluded and will be prepared for shipment; changes will no longer be accepted, obviously without prejudice to the rights of the customer referred to in article 7 below.

Once the order has been received, “Azienda Agraria Hispellum” will check the availability of the products in its stock for the fulfillment of the order. In the event that one or more Products are not available, “Azienda Agraria Hispellum” will promptly notify the Customer via email who, within the next 24 hours, will have the right to reply to confirm the shipment of the available products or possibly add others, or cancel the order. If there is no response within this period, the order will be considered confirmed and only the available products will be shipped. In this case, the amount relating to the missing products will be deducted from the initial total amount of the order.

All information on the Products is given in Italian. “Azienda Agraria Hispellum” guarantees that Products identical to those indicated and described on the Site will be delivered, and ensures compliance with all regulations regarding the conservation of the products until the time of delivery in the place indicated by the user when ordering. The manufacturer’s responsibility applies to all products sold. In the case of packaged products, the manufacturer is also responsible for the truthfulness and completeness of the information on the packaging.

Product prices are inclusive of all taxes and duties. All prices are expressed in Euros.

For “Azienda Agraria Hispellum” it is important that purchases are protected from sudden changes in temperature and accidental shocks during shipment. For this reason the products are properly packaged.

The Customer may pay the price of the Products and the related delivery costs by credit card.

The Products purchased on the Site will be delivered to the address indicated by the Customer during the purchase procedure in the appropriate “Shipping Data” field.

All purchases will be delivered by courier (hereinafter, “Courier”) from Monday to Friday, excluding holidays and national holidays. “Azienda Agraria Hispellum” is not responsible for unforeseeable delays or those not attributable to it.

In any case, except for reasons of force majeure or unforeseeable circumstances, the ordered Products will be delivered approximately within a period of 7 (seven) working days starting from the day following that in which “Azienda Agraria Hispellum” confirmed the order to the Customer. by means of a specific order confirmation email. The aforementioned term of 7 working days applies for shipments to Italy.

Active delivery services in Italy: …

The service includes 1 delivery attempt at the address indicated at the time of the order. If the delivery attempt is unsuccessful, the courier will leave a paper notice of the passage asking the customer to contact the nearest office to arrange the delivery or to change the address of the same. The Courier reserves the right to contact the Customer by telephone in case of non-delivery instead of leaving a written notice.

As required by the Consumer Code Legislative Decree 206/05 (ex right of withdrawal) and by Legislative Decree 21/2014, the customers of the Hispellum Agricultural Company enjoy the satisfaction or refund guarantee with the possibility of returning the products purchased within 14 days. working from receipt, except in the case of products which by their nature are excluded pursuant to art. 59 of Legislative Decree 21/2014 and are:

1. the supply of goods made to measure or clearly personalized;
2. the supply of goods which are liable to deteriorate or expire rapidly;
3. the supply of sealed goods which are not suitable for return for hygienic reasons or related to health protection and have been opened after delivery;

 

With reference to these cases of exclusion, the Customer is informed and accepts that the Products that “risk deteriorating or expire rapidly” include all Food Products, as the characteristics and qualities of these types of Products are also subject to alteration as a result of inappropriate storage. Therefore, for reasons of hygiene and customer protection, the right of withdrawal is applicable only for Products purchased on the Site that can be returned to the Hispellum Agricultural Company and put back on the market without endangering the health of consumers (i.e. cosmetic products). .

 

The procedure for exercising the Right of Withdrawal requires a communication from the Customer which must be sent by registered letter with return receipt, addressed to:

The Customer Service of the Hispellum Agricultural Company will, once received the communication, open a file for the management of the return and to communicate to the Customer the instructions on how to return the Products, which will be done by courier indicated by the Hispellum Agricultural Company.

The right of withdrawal is governed by the following conditions:

In case of exercise of the right of withdrawal, the Hispellum Agricultural Company will refund the customer the full amount paid to purchase the goods subsequently returned, including shipping costs where applicable, within 14 days from the date on which the communication of withdrawal, without prejudice to the right of the Hispellum Agricultural Company to suspend the payment of the reimbursement until the actual receipt of the goods. The refund will be made using the same payment method used by the Customer, unless the latter has expressly requested a different method of credit. In the event of a bank transfer, the Customer will be responsible for providing the bank details to obtain the refund (account holder, name and address of the Bank and IBAN).

Also in order to guarantee the free return, the Products must be returned in the same type of packaging in which they were received.

 

In cases of exclusion of the right of withdrawal, Azienda Agraria Hispellum will return the purchased Products to the Customer, charging the shipping costs to the same.

In case of acceptance of the right of withdrawal, the Hispellum Agricultural Company offers Free Returns keeping the shipping costs for returning the Products fully at its own expense.

The Customer must wait to be contacted by Azienda Agraria Hispellum to agree on the return of the Products to the courier.

In case of lack of conformity of Products sold by Azienda Agraria Hispellum, the Customer must immediately contact Azienda Agraria Hispellum by telephone or by sending an e-mail to mciampetti@hispellum.com

The legal guarantees provided for in articles 129, 130 and 132 of the Consumer Code apply to the sale of the Products. The Customer has the right, at his choice and on condition that the type of Product allows it, to restore, without charge, the conformity of the Product by repair or replacement, or to an adequate price reduction or termination of the contract. The Customer loses these rights if he does not report the lack of conformity to Azienda Agraria Hispellum within two months from the date on which he discovered the defect, provided that it is not a Product which by its nature is perishable or subject to expiry. in a shorter period, in which case the defect must be reported within this shortened period.

The information relating to the Products provided through the Site is constantly updated. However, it is not possible to guarantee the complete absence of errors for which Azienda Agraria Hispellum cannot therefore be held responsible, except in the case of willful misconduct or gross negligence.

Azienda Agraria Hispellum reserves the right to correct errors, inaccuracies or omissions even after an order has been sent, or to modify or update information at any time without prior notice, without prejudice to the Customer’s rights under these General Conditions and the Consumer Code.

Except for willful misconduct or gross negligence, any right of the Customer to compensation for damages or the recognition of compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and / or things, caused by the non-acceptance or evasion, even partial. , of an order.

The sales contract between the customer and Azienda Agraria Hispellum is concluded in Italy and governed by Italian law. For the solution of disputes relating to the interpretation, execution or resolution of these General Conditions or individual purchase orders if the Customer is a consumer pursuant to the Consumer Code, the court of his / her town of residence or of domicile if located in the Italian territory; in all other cases, the territorial jurisdiction is exclusively that of the Court of Perugia, any other competent court excluded.
